Copyright and Usage Policy


1. Ownership of Work

All intellectual property rights, including but not limited to copyright, to the images, videos, behind-the-scenes footage, and other work produced by Collabarts ("the Work") remain the exclusive property of Collabarts. We retain the right to:

  • Use, publish, and display the Work in any format, on any platform, and for any purpose we deem fit, including but not limited to, our website, social media, portfolio, and marketing materials.

  • Modify, edit, and re-edit the Work at our discretion, including altering the composition or appearance of the images/videos for promotional purposes.

  • Share the Work with our clients, partners, and collaborators as necessary for portfolio or marketing purposes.

2. Client Usage License

We grant clients a limited, non-exclusive license to use the Work as outlined in the license below. The scope and extent of the license depend on the specific level agreed upon in the production quote.

Regular License (Included & Free)

This license is included in all standard projects and grants the client the following usage rights:

  • Digital Marketing: The Work may be used for digital marketing purposes, including on social media platforms and websites.

  • Small-Scale Print Usage: The Work may be used for printing on packaging, flyers, thank you cards, and similar promotional materials.

  • The Regular License is non-transferable and only applicable for the aforementioned uses.

  • Expiry: This license is valid for 12 months from the date of delivery of the final work.

License Level 1 (5% of Production Quote)

This license applies for the following usage and is available for an additional 5% of the total production quote:

  • Point of Sale (POS) Systems

  • Storefront Signage

  • In-Store Digital and Print Signage

  • Banners and Similar Displays

  • Expiry: This license is valid for 12 months from the date of delivery of the final work.

License Level 2 (10% of Production Quote)

This license applies for large-scale print and advertising materials, and is available for an additional 10% of the total production quote:

  • Large-Scale Prints: Billboards, tabloids, and street advertising

  • Vehicle and Bus Wraps

  • Public Transport Signage

  • Large Signage for Events and Locations

  • Expiry: This license is valid for 24 months from the date of delivery of the final work.

License Level 3 (15% of Production Quote)

This license applies for mass media campaigns and is available for an additional 15% of the total production quote:

  • TV Commercials

  • Digital Billboards and Screens

  • Cinema Advertisements

  • Major Sports Event Advertisements (Super Bowl, AFL, etc.)

  • Expiry: This license is valid for 24 months from the date of delivery of the final work.

3. Model and Creative Contractor License & Usage

Models, makeup artists, voice-over artists, and any other creatives or contractors working with Collabarts ("Creatives") will have the right to use the Work created during a project for their own promotional and marketing purposes. This includes the right to:

  • Use the Work in their own portfolios, social media profiles, websites, and other promotional platforms.

  • Display the Work in any form, including digital and printed formats, to showcase their contribution to the project.

  • Limits: This usage is strictly for non-commercial purposes related to their work in the creative industry. Creatives are not authorized to resell or redistribute the Work beyond showcasing it for their promotional needs.

  • Expiry: The usage rights for Creatives are perpetual, provided that the usage is limited to their portfolio and promotional purposes.

The client acknowledges that the Creatives may use the Work for their promotional purposes, and by engaging with Collabarts, the client agrees to allow this. Collabarts is not liable for any disputes or issues arising from such usage, and it is the responsibility of the client to communicate any concerns directly with the Creatives involved.

4. Behind-the-Scenes (BTS) Footage and Photos

  • BTS Media Usage: Collabarts may capture behind-the-scenes footage and photos during the production process, including but not limited to, video and photo recordings of the set, team members, and interactions during the shoot.

  • Client Consent: By engaging with Collabarts, the client grants us permission to use this BTS media for promotional, portfolio, and marketing purposes, including sharing on social media, websites, and in other public platforms.

  • Promotional Use: BTS photos and videos may be used in various marketing channels, including but not limited to social media, blogs, and press outlets, to showcase the production process and our creative team’s work.

5. Use of Media Outlets

  • Media Outlets & Publicity: We reserve the right to use the Work in various media outlets, including but not limited to online publications, print media, television, or any other type of public distribution for promotional purposes. We may feature the Work as part of our portfolio or marketing campaigns.

  • Client's Acknowledgment: By engaging in our services, clients acknowledge that the Work may be publicly shared through media outlets, and no additional approval or compensation will be required unless specified otherwise in writing.

  • Media Usage: Collabarts reserves the right to share the Work with media outlets such as industry publications, blogs, or other promotional platforms to further showcase the Work, provided that the usage complies with the terms of the license granted to the client.

  • Expiry: Any public use by Collabarts in media outlets or other platforms does not alter the original licensing terms granted to the client.

6. License Expiry

Each of the above licenses expires at the end of the designated period (as noted for each license level). If the client wishes to continue using the Work beyond the agreed period, they must request and purchase an extension of the license from Collabarts at the prevailing rates.

7. Restrictions on Use

  • Transferability: These licenses are granted solely to the client named in the agreement and are non-transferable.

  • Prohibited Uses: The Work cannot be sold, sublicensed, or used in any way not expressly stated in the relevant license.

  • No Resale: The Work cannot be resold, reproduced, or used in any commercial way outside of the granted license terms.

By engaging with Collabarts for services, clients agree to abide by the terms and conditions of this Copyright and Usage Policy. If the client does not adhere to the terms of the granted license, Collabarts reserves the right to take legal action to protect its intellectual property rights.
