This Reshoot Policy outlines the terms under which Collabarts will address reshoots for photography and video projects. It is designed to balance client satisfaction with fairness and operational practicality while adhering to the requirements of the
Australian Consumer Law (ACL)
under the
Competition and Consumer Act 2010 (Cth)
.
Collabarts is committed to providing deliverables that meet the agreed-upon scope and brief. Any concerns regarding the final output must be communicated promptly and will be assessed on a case-by-case basis in accordance with this policy.
2.1. Delivery Failure Due to Collabarts’ Actions
If Collabarts fails to deliver the agreed services due to errors such as:
Loss or corruption of raw files before final delivery,Technical issues during production caused by equipment malfunction or operator error,
a reshoot will be provided at no cost to the client.
2.2. Non-Compliance with the Approved Brief
If the deliverables fail to meet the agreed-upon brief due to Collabarts’ error (e.g., incorrect execution of logistical or technical requirements), Collabarts will arrange a reshoot at no additional cost.
Note:
Subjective creativity, artistic interpretation, or misunderstanding of the brief by the client will not qualify for a complimentary reshoot. Clients are responsible for clearly communicating all creative and logistical requirements during the pre-production phase to ensure alignment.
3.1. Subjective Dissatisfaction
Reshoots will not be provided for dissatisfaction based on personal preferences or stylistic opinions where the deliverables align with the approved brief.
3.2. Post-Shoot Changes
Requests for changes to elements such as backdrops, props, or product positioning after the shoot has been completed are not eligible for a free reshoot. These must be finalised during the pre-production phase.
3.3. Client-Requested Reshoots
If the client requests a reshoot for reasons unrelated to Collabarts’ actions or errors (e.g., changes in creative direction or rebranding), the reshoot may be accommodated at the client’s expense.
4.1. Pre-Production Approval
The client must ensure all elements of the brief, including creative direction, logistics, and technical requirements, are reviewed and approved prior to production.
4.2. Attendance and Feedback
Clients are encouraged to attend shoots or provide real-time feedback remotely (if applicable) to ensure the deliverables align with their expectations.
Collabarts is not liable for delays or additional costs arising from circumstances beyond its control, including but not limited to weather disruptions, natural disasters, or unforeseen technical issues. Reshoots under these conditions will be subject to mutual agreement.
This policy does not limit the rights of clients under the Australian Consumer Law.
If the deliverables are not provided with due care and skill or fail to meet the agreed-upon scope, clients may be entitled to remedies under the ACL.
